What is 'Duty of Care'?

There is no one specific “Duty of Care” law.

The “Duty of Care” responsibilities of a company are the direct effects of a number of different laws aimed at making companies more responsible for the on-road activities of their drivers.

Failure to take responsibility for these activities (or put in other words, failure to demonstrate Duty of Care) is like opening many potential doorways to severe punishment by the law. If a serious injury or death occurs due to the actions of a company driver and sufficient Duty of Care cannot be shown, then punishment will be aimed at the company and its senior managers responsible for the area of incident, and the punishment won't be light!

Duty of Care...in a nutshell...

It's not an option, it's a necessity. A company and it's managers must take the time before the unthinkable occurs to make sure all responsibilities towards Duty of Care are actioned, not just to protect drivers but also to protect the company's reputation and the reputation of any senoir individual that might end up in 'the firing line' (something we'd never wish upon anybody).
